Terms of Service

These Terms of Service apply when you use the Avellaire Home website or purchase products from us. By placing an order, you agree to these terms. Nothing in these terms affects your statutory consumer rights.

Products

We take reasonable care to describe and photograph our products accurately. Colours may appear slightly different depending on your screen.

Some products may be handmade, hand-finished, vintage or individually sourced. Natural variations, signs of age and minor differences may therefore form part of their character. Any significant damage, faults or imperfections known to us will be stated in the product description and shown in photographs where possible.

Orders

When you place an order, Shopify will send an acknowledgement to the email address you provide. This confirms that we have received your order but does not guarantee acceptance.

A contract is formed when we confirm that your order has been dispatched. If we cannot accept or fulfil an order, we will contact you and refund any payment taken.

We reserve the right to refuse or cancel an order where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised or we reasonably suspect fraud.

Prices and payment

Prices are shown in pounds sterling. Avellaire Home is not currently registered for VAT, so VAT is not separately charged.

Delivery charges are shown at checkout before payment. Payment must be authorised before an order can be dispatched.

Delivery

We currently deliver within the United Kingdom only. Delivery charges, preparation times and estimated delivery times are explained in our Shipping Policy.

Delivery dates are estimates unless we have expressly agreed a specific date with you. We are not responsible for delays caused by events outside our reasonable control, but we will keep you informed and help resolve delivery problems.

Responsibility for the goods passes to you when they are delivered to you or to a person nominated by you. Ownership passes to you once we have received payment in full.

Cancellations and returns

Your rights to cancel an online order, return an item and receive a refund are explained in our Return and Refund Policy.

For most online purchases, you may tell us that you wish to cancel within 14 days of receiving the goods and then have a further 14 days to return them. Certain legal exceptions apply, including some personalised, made-to-order, perishable or hygiene-sensitive products.

Your statutory rights remain unaffected.

Faulty, damaged or incorrectly described goods

Products must be as described, of satisfactory quality and fit for their intended purpose. If an item arrives damaged, is faulty or is not as described, please email avellairehome@gmail.com with your order number and photographs where possible.

We will explain the available remedy, which may include a repair, replacement, price reduction or refund, depending on the circumstances and your legal rights. We will cover reasonable return costs where an item is faulty, damaged or incorrectly described.

Website availability and information

We aim to keep the website available and its information accurate, but we cannot guarantee that access will always be uninterrupted or error-free. We may update product information, prices, availability or website content when reasonably necessary.

Intellectual property

The Avellaire Home name, branding, photographs, product descriptions and original website content belong to us or are used with permission. They must not be copied, reproduced or used commercially without prior written permission.

Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

We are responsible for losses that are a foreseeable result of our breach of these terms. We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses where you are purchasing as a consumer.

Privacy

We handle personal information in accordance with our Privacy Policy. Shopify and the payment providers used at checkout may also process information needed to complete your order and payment.

Changes to these terms

We may update these terms when reasonably necessary, for example to reflect changes to our business, website or the law. The terms applying to your purchase will be those displayed when you place your order.

Governing law

These terms are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections that apply where you live and may bring proceedings in the courts available to you under applicable law.
